The issue in the instant case is wheather one party to the contract, seller can sue the second party, buyer, who breachs the law by denying to fulfil the conditions of the contract.
The non-breaching party in this case has two options: firstly, assuming that they are released from contractual obligations, they may bring an action for demages. Secondly, they can wait as long as the infringement of the contract, which is still binding, is harmfull for the breaching side.
Under the reliance principle if one party to the contract breachs it's conditions, the second one schould be released from the contractual obligations as well.
