The goal of our thesis is to reflect on this legislative ban as it is seeing in France and in Quebec, in order to find out the meaningful factors in each legislation that make the employee feel comfortable both in thinking that he is protected against morał harassment and that his employer will take all the means to initiate protection in the workplace.
Our research primarily focused on comparing French and Ouebecer legislations that prohibit psychological harassment, then follows jurisprudential illustrations to evaluate how the legislation is being manifested in the workplace. The study reveals some similarities and differences among the two legislations. One important point however is that, each regulation depending of the context in which it is applied meets the expectation set by the legislators.
