This is a license agreement between MOMENTUM NETWORK, INC., doing business as premiumbeat.com (“premiumbeat”) and you, the licensor. You agree to be bound by the terms and conditions of this End User License (the “Agreement”), which are as follows:

Premiumbeat grants you a nonexclusive, worldwide, perpetual license to use the Music Player on websites in accordance with these terms.

You can use any of our free music players on any websites, including those for your clients. However, you may not resell or redistribute these products in any way or combined with another product without prior permission.

Unauthorized Distribution and Resale You may not place any of the Music Players on a CD, diskette, website or any other medium and offer them for resale.

Modifications You cannot make any modifications or changes to these products.

Ownership You may not claim intellectual ownership of these products. All products remain as the property of Premiumbeat.

Disclaimer Our Music Players are provided "as is" without any warranty of any kind, either expressed or implied. In no event shall we be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products.

Music disclaimer We expect users to play audio files for which they have the legal right to do so. You hereby agree to refrain from making unauthorised use of music owned by third parties, using the Premiumbeat Flash Music Player. You are responsible for obtaining the required legal authorisation to play music, including without limitation obtaining public performance licenses. Premiumbeat assumes no responsibility whatsoever for your unauthorised use of music.

Premiumbeat.com reserves the right to modify the terms of the present End User License Agreement at any time, at its sole and exclusive discretion.
