Re: Claim against Mr Fasasl Moghal
We write regarding your claim in relation to your landlord’s failure to secure your bond In a Government protection Scheme. Mr. Moghal is happy to return the bond, however we are more than prepared to go to a Tribunal in relation to this matter, as your additional allegations are unfounded and farcical.
I’m happy, that Mr. Moghal is happy. I still don’t understand why he don’t secured my bond in a Government Protection Scheme and why he still don’t give me back my money?
Sarah Sugden write:
We must advise you that if you are to go ahead with this claim, it leaves us no choice but to counter sue for Criminal Damages and costs.
I have not damaged property and my friend Anna Pietraszek see it also last day, how carefully and thoroughly I was clean WHOLE flat, just every, everything, also walls, doors, windows, whole cupboards in kitchen, whole bathroom and room, just everything. Nothing was damaged.

We know that you kept a pet, specifically a cat, in the property against the terms and conditions of your Tenancy Agreement and further blatantly against the word of the landlord.
Mr Moghal in 16 of July signed agreement with Katarzyna Dec and on this agreement he personally by his hand write – he is agree and allowed for a cat which you are talking about. It was adult, old – (quiet, calm) - cat. Important for me is, that THE CAT WAS LIVE IN THIS FLAT as household member BEFORE I came and start live here as a household member. So I was agree to live in this flat with the cat, which Mr Moghal personally made this cat as a household member.
I have not with me no one pet and my 13-y.o. daughter also.
The Council have this Agreement and will sending it to me, so I will able show it.

We are not prepared to entertain your other allegations as you were made fully aware that if you hermetically sealed the flat condensation would occur and that would lead to damp.
I don’t understand this. I live in UK nine years and many times changed flats and never had problems. So this is first one flat, that I was not enough clever to use it? I opened windows on a regular basis. I cleaned mould from the walls on a regular basis. The flat was damp and moudly.

We are also aware that you moved your family into the flat against the conditions of the Tenancy Agreement and that in doing so you caused illegal overcrowding.
I am a single mother and Mr. Moghal was know, that I have 13 y.o. daughter which live with me all time and everywhere I am. So in his flat was Katarzyna (and cat), which have first tenancy agreement with Mr Moghal. Katarzyna was asking him – can we live together, or she will need to leafe his flat. Because Mr Moghal was agree - me and my younger daughter come to live in his flat. So… in this flat was 2 adult person and one 13y.o. child - almost like married family with one child.
If this is illegal overcrowding why Mr Moghal was agree and let me live in his flat and signed with me tenancy agreement?
I am advised that overcrowding refers to local authority accommodation not private lettings. In any event I dispute the landlords allegations.

Furthermore, we are of the understanding that you altered the dates on the Tenancy Agreements to fiddle your entitlements to Local Housing Allowance. We are again more than happy to notify the City Council of your fraudulent behavior and as a result you will have to repay in full the Local Housing Allowance that you have received.
This is a very serious allegation. Are you accusing me of fraud?
Again, one more time I am informing you, that Council has all information and agreements.
I was come to start live in Mr. Moghal flat 1st of August and this date wasn’t any “altered” but was true date, when I sign agreement with Mr Moghal and start live in his flat.
Because Mr. Moghal – when Katarzyna asking him was agree – I quickly found new tenant for my previous Landlord to help him and I change address. The new tenant also start live in my previous flat from 1st of August. So I don’t understand where is my disgraceful behavior? Mr. Moghal was know, that I am single mother and have Housing Benefit and signed for me “Landlord’s page” for Housing Benefit.
Everybody who looking flat for life – ask all landlords for start – is he agree for child and is he agree for Housing Benefit. Mr Moghal was agree.

We would strongly advise you to settle out of court for repayment in full of the bond. Should you wish to take the matter further, we will have no choice but to act as stated above.
Mr Moghal still don’t give me my money back. I was clean whole home before I go out. On date, when I go his agent come with a new tenant. Mr Moghal check all – very, very properly, everything is clean and write for me cheque as part he own me. I was waiting one week for money, but I never see money. After few days he send text, he found some cat’s hair… Only this. Now, today – after six months - he found any damaged?
When Katarzyna was signed Tenancy Agreement with Mr Moghal – we were asking him give to rubbish materace, because nobody normal can’t sleep on something like that. We ware buy new one. Mr Moghal promised two times when we signed agreements to change old, rubbish carpet and many times after, when he come to flat. Never do it, but after all, when he should give me back my money, he write, that he need to bough a new carpet…
After all I was write to him e-mail and last time ask him for back me my money. I was write to him, that I will go to court. He’s answer wasn’t nice and he don’t give me back my money.
I understand Solicitors letter – The Solicitor know only, what Mr Moghal said him, but his words are contrary to the truth, proof of documents and they are in opposite what he said to what he doing.
I wish now for the Court to deal with this matter. It is too late for negotiations to begin.
